The Legality of Hemp-Derived CBD

 Thanks to the 2014 Farm Bill, CBD when derived from the Sativa L. hemp plant is legal. Because CBD from hemp has no psychoactive effects, the purchase, sales, or possession of hemp derived CBD products are federally legal with no script needed. A prescription is needed for any CBD products derived from marijuana. All hemp derived products must not exceed 0.3% THC. The updated 2018 farm bill removed hemp from the definition of marijuana clearing up some gray area in legality since 2014. Each state has the right to submit there own hemp program to the USDA, so be sure to comply with each states laws.  Unfortunately hemp is sometimes confused with the marijuana plant and due to lack of awareness there is still some stigma towards CBD. From the  legal perspective, hemp-derived CBD is completely legal and enjoys the rights of any other legal product!
